Terms of Use and Agreement — Professionals

1.- Ownership

2.- Acceptance

This website and the services provided (hereinafter the Service) are available to any user and are subject to the following terms and conditions: these Terms of Use and Agreement, our Privacy Policy and our Cookie Policy.

By using the Service you accept our terms and conditions. In doing so, you undertake not to use this site for illegal purposes. The language in which the contract will be concluded is Spanish, regardless of whether documents in other languages are displayed on the website or the user chooses to use automatic translation tools; in the event of a conflict between the wording shown in one language or another, the Spanish version shall always prevail.

Furthermore, we inform you that for legal reasons we archive the electronic documents formalising contracts for our paid services. You may access such documents at any time by requesting them at: info@artistealo.com

Invoices will be issued electronically, although you may request a paper copy at any time.

3.- Description and Use of the Service

3.1.- Description

The Service is an intermediary platform that allows various professionals to offer their services and clients to acquire them according to their preferences. You may use the Service to acquire third-party services or to offer, manage and promote your services as a professional.

The provision of the Service to Professionals is carried out as follows:

When you access our platform, you can activate your professional profile, define the services you offer, the category you belong to, and the conditions, cost and location of those services, among other aspects.
You may also choose to subscribe to subscription plans or add-on services that will give your professional profile certain features not available in the free plan. Professionals who subscribe to the service will be able to negotiate directly with clients, and the client will pay them directly, with no commission charged by the service.
If you are hired by a user without having a subscription, the platform will manage the payment through its payment gateway and will subsequently transfer the amount to the relevant professional.

3.2.- Intermediation

Artistealo facilitates the connection between professionals and users, acting solely as an intermediary between the parties.

In this regard, Artistealo assumes no obligation or liability in respect of the service you provide, which shall be the sole responsibility of the professional.

If a user requests a modification or extension of the originally agreed commission, they must do so through the platform and request a new quote. We cannot under any circumstances be held responsible for agreements made between the User and the Professional outside our platform.

Accordingly, Artistealo grants you the right to use a platform that allows you to publish and offer services in order to be hired by third parties. When users hire your service, they enter into a contract directly with you; Artistealo is not a party to and does not intervene in any other way in the contractual relationship between the users. Artistealo acts solely as a collection agent in accordance with the provisions of these Terms of Use and Agreement.

Artistealo does not and cannot control the conduct or performance of professionals and users registered on the platform and cannot guarantee the quality, safety or suitability of any service, nor the truthfulness or accuracy of the descriptions in listings or the requests or reviews made by users.

You therefore acknowledge that Artistealo has no general obligation to monitor use of the platform or to verify the information provided by users, but does have the right to review, disable access to, remove or edit content in order to: manage, protect and improve the platform for the purposes of fraud prevention, risk assessment, research and customer service.

Separately, Artistealo may offer, within its paid or premium services, services involving the verification of a given professional in order to certify their identity, or payment protection, in the sense that payment is only released once the service has actually been rendered.

3.3.- Provision

In order for us to provide the Service, you must register as a Professional, completing the information requested with truthful and accurate data.

Once the Registration process and the creation of the Account are complete, the Professional may access their Profile at any time to update or modify the data entered, including information relating to their services.

The Professional shall be solely responsible for the accuracy and currency of this information. If they do not complete their profile after providing their email address and/or any other requested data, they may receive a limited number of communications inviting them to complete the Registration process.

Artistealo reserves the right to verify and validate Artistealo Accounts where it has reason to believe that the email addresses provided are not valid and/or legitimately used and/or legitimately created.

Likewise, Artistealo reserves the right not to display the professional profile if the necessary information (logo and/or images and/or text) has not been completed, or to stop displaying the profile for reasons it deems appropriate.

As a professional, you must accept that, in order to attempt to guarantee the provision of services contracted by the user, Artistealo may retain the price paid by the user until the date the service is to be performed. If no complaint has been received within 24 hours of the date on which you were due to perform the service indicating that it was not performed, Artistealo will make the corresponding payment; otherwise, it will initiate a verification procedure to check whether the service was performed and under what conditions.

3.4.- Professional contracts and subscriptions

Registration on the platform is free. After registration, registered professionals may opt for an individual or monthly subscription; with the monthly subscription, professionals will be included in the Artistealo catalogue.

When users submit a general quote request, it will be received by all professionals matching the user's request. Users may also request a quote from a specific professional from the Artistealo catalogue.

To access the data in these quote requests, Artistealo grants the professional 3 free quotes upon first registration on the website. Once the 3 free quotes have been sent, a paid plan will be required.

The Service offers various subscription plans differentiated by term and the services included in each plan.

You may cancel your subscription to the Service at any time, and you will continue to have access to it until the end of your monthly billing period. To the extent permitted by law, payments are non-refundable and we do not provide refunds or credits for partial monthly subscription periods.

3.5.- Add-on services

You should also be aware that the Service may provide additional services beyond those included in your subscription.

For example, we may individually verify your identity and profile, in order to inform potential clients that your profile and its features have been verified. For more information about this and other services, contact us at info@artistealo.com

We may also offer all or some end clients who contract it a payment protection service whereby we retain the amount due for your services until it is confirmed that the service has actually been rendered under the agreed terms.

If contracted by the end client, you understand and accept that we will retain the amount due for your services for up to 24 hours after the date set for the provision of the service.

During that period, you or the client may and must confirm that the service has been rendered as contracted. In the event of a dispute between you and the client, the Service will use all means at its disposal, including giving both parties a 5-day period to submit their arguments and evidence as they see fit, in order to verify the following:

That the Service was rendered.
That its essential characteristics (duration, dimensions if applicable, etc.) are consistent with those contracted.

To this end, in the event of any discrepancy regarding actual performance, you should take photographs or images that you can provide to us through our usual contact channels.

We will not under any circumstances assess subjective factors such as quality, originality, fulfilment of expectations or general satisfaction.

If we verify such circumstances, payment will be made as soon as possible. If it is established that you failed to meet the minimum objectively required standards for your activity, did not meet what was contracted by the client, or did not render the service, payment will not be made.

The Service's decision on whether the contracted service was actually rendered shall be final, expressly excluding any liability in this regard, and from that moment on the Service shall not be involved in any action or claim that the parties decide to pursue between themselves.

3.6.- Use

Users and Professionals undertake to use the Service in accordance with applicable law and the terms and conditions of the platform.

Whether you are a User or a Professional, you are responsible for all activity that occurs under your account and undertake at all times to keep your account username and password secure and confidential. Unless Artistealo permits otherwise in writing, you may only hold a single account per User or Professional.

All users of the service also undertake not to collect data for advertising purposes, send advertising of any kind or communications for sales purposes or of a commercial nature. They may not make data collected from the Service available to third parties for any purpose.

Similarly, in the event of damage, disabling, overloading, impairment or prevention of normal use of the materials and information contained in the Service, the information systems or the documents, files and all types of content stored on any computer equipment of the Service, its members or any user of the Service.

4.- External links

The Service may direct you to other websites via links. However, Artistealo has no control over those sites or their content, which are subject to their own terms and conditions. Therefore, Artistealo is not responsible for the quality, truthfulness or accuracy of the information contained therein.

5.- Age

With regard to registration on our Service, or the offering or contracting of any third-party service, you declare that you are of legal age and have the legal capacity necessary to be bound by this agreement and to use the site in accordance with its terms and conditions, which you fully understand and acknowledge.

If you contract on behalf of a company, you acknowledge that you have the appropriate authorisation and representation on behalf of the organisation to do so.

You declare that all the information you provide to access the Service, before and during its use, is truthful, complete and accurate.

6.- Intellectual and industrial property and licence

6.1.- Intellectual and industrial property

The content and information of the Service (including, among other things, data, text, sound, images or computer code), as well as the hardware or software elements used to provide such content and information, are the property of Artistealo or it holds the corresponding authorisations for their use.

Artistealo owns, or holds the relevant authorisations for, all copyrights, trademarks, domains, logos, trade images, trade secrets, patents and other associated intellectual property rights. You may not use our copyrights, trademarks, domains, logos, trade images, patents or other intellectual property rights unless we expressly grant you permission to do so. Furthermore, modification, reproduction, duplication, copying, distribution, sale, resale and other forms of commercial or equivalent exploitation of the Service are prohibited.

Users and Professionals undertake not to apply, themselves or through third parties, for any trademark, trade name or commercial name, establishment sign, domain name or similar denomination or identification to the products, services or name of Artistealo or its Professionals. They also undertake not to apply for registration, patent or any other type of legal protection or attribution of any intellectual or industrial property rights belonging to Artistealo or its Professionals.

6.1.1.- Claims

Artistealo is committed to helping individuals and organisations protect their intellectual property rights. Our users and Professionals accept our terms upon accessing or using our Service. Our terms do not permit our users to infringe or violate anyone else's intellectual property rights, including their copyrights and registered trademarks.

To notify a possible infringement of copyright or registered trademark rights and request that Artistealo remove any content it holds on the Service that may be unlawful, please send us an infringement notice including: your contact information, the work that is the subject of the infringement, the content that infringes that work, where that work appears on our Service, reasons why you consider that infringement to exist, and your signature.

6.2.- Licence

For the provision of the Service, we grant you a limited, revocable, non-exclusive licence that cannot be sublicensed or transferred to use our Service, subject to and in accordance with our terms and conditions. This licence is granted for the sole purpose of allowing you to use our Service in the manner stipulated in our terms and conditions.

Furthermore, by publishing content on the site, the Professional grants Artistealo a royalty-free, non-exclusive licence with no territorial or time restrictions, until you request deletion of the account, to use, reproduce, distribute, transfer to third parties, sublicense, and display the Content, in connection with the provision of Services by Artistealo, as well as in the context of Artistealo's commercial and/or advertising services and activities, including, for example, promoting and redistributing all or part of the Site in any format and through any distribution channel.

You are not permitted to use, copy, adapt, modify, distribute, licence, sell, transfer, publicly display, publicly perform, transmit, broadcast or exploit the Site or the Content published on it, except as expressly permitted in these General Terms and Conditions. If you download or print a copy of any Content for personal use, you must respect all copyrights and other proprietary notices it contains.

7.- Content

7.1.

You may contribute to the Service by sending us messages to our email address, through the contact form or by sending messages through the platform's messaging system (hereinafter "Content").

We may use your Content in various ways, such as: displaying it on the website, reformatting it, translating it into other languages, editing it for clarity, correcting errors, promoting or distributing it.

Therefore, by sending us Content you grant Artistealo a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence over that Content until the content is withdrawn.

This means the content remains yours, but Artistealo, thanks to that licence, may: a) use, reproduce, modify, adapt, translate, distribute and publish the Content, create derivative works from it, and display and exhibit it worldwide, by any means known and for any legitimate purpose; and b) use the name you submit in connection with that Content.

7.2.- Professional Profiles

As a Professional, you will have an associated profile from which you can offer your services under your own conditions and prices. In any event, you will be subject to the following obligations:

You must provide the service offered under the terms advertised and in accordance with the bookings you receive from users. If the Client requests extensions or modifications to the service, you must prepare a new quote, communicate it to the client through the platform, and only take on the commission after the client has accepted it.
You must comply with your legal obligations in respect of the relevant service, personal data processing, any licences required, and the declaration, collection, settlement or inclusion in the price of VAT or other applicable indirect taxes, fees, income taxes or other levies.
You must maintain an Artistealo profile with contact information including one or more of the following: email address, telephone number and/or website address. Make sure the information is accurate and up to date. You must not impersonate another business or professional or otherwise mislead, deceive or misrepresent to clients the nature of your business and the services provided.
You must respect the privacy rights of users and comply with all requests (both within and outside Artistealo) that individuals send to block, stop or otherwise opt out of the communications you send them through Artistealo, including removing that person from your contact list.
You must ensure that you publish your listings within the appropriate category and section.
You may not manipulate the prices of services offered to the same Client or engage in acts of unfair competition against other Professionals offering identical or similar services.
You must not circumvent or manipulate the fee structure, billing or fees owed to Artistealo, or contact the Client by means other than those offered by Artistealo until the Client has contracted and paid for your services.
You undertake to provide your tax identification number. If the information entered by the Professional is not suitable, according to Artistealo's internal rules, for successfully completing the verification process, Artistealo reserves the right to: a) request modification of the Profile Content; b) request the submission and copy of any supporting documents (e.g. copy of tax identification number); c) delete the Professional's account.

7.3.- Prohibited activities

All users and professionals undertake not to carry out any of the following acts:

a) Access, monitor or copy content or information from this website using robots, crawlers, data scrapers or any other automated means without the explicit written permission of Artistealo;

b) Insert, mirror or otherwise incorporate any part of this website into another without our prior written authorisation;

c) Attempt to modify, translate, adapt, edit, decompile, disassemble or reverse engineer any software program used by Artistealo;

d) Use the website to threaten, harass, defraud, incite, intimidate or otherwise interfere with another user's use of the website;

e) Use the website to send or transmit unsolicited mail (spam), chain messages, contests, junk mail, pyramid schemes, surveys or other bulk messages;

f) Use the website to infringe the rights of third parties, including copyright, trademarks, patents, trade secrets, moral rights or privacy rights;

g) Attempt to gain unauthorised access to the website through hacking, password extraction or the transmission of computer viruses;

h) Use any device, software or routine that interferes with the proper operation and security measures of the website;

i) Post fictitious quote requests in order to collect data or for your own commercial purposes.

7.4.- Services not permitted

Artistealo does not under any circumstances permit the provision of the following services:

Sale of products: Artistealo allows Professionals to offer Clients services only, not products.
Lending and consumer credit services: Artistealo does not permit lending and consumer credit services, debt claims, assistance, foreclosure, refinancing or banking or financial services of any kind.
Sexual services or services for sexual purposes: Artistealo does not permit sexual services or services for sexual purposes, such as: prostitution, dating, erotic calls, escort services, exchange of erotic massages, exchange of contacts for the purpose of sexual encounters, etc.
Long-term rental services: Artistealo does not permit the provision of rental services for residential or professional use (e.g. rental of offices, rooms, dwellings, garages or storage units).
Tourist services: Artistealo does not permit the offering of tourist services of any kind and does not accept hotels, Bed & Breakfasts (or similar) promoting tourist services, accommodation offers and holiday packages.
Event listings: Artistealo allows Professionals to offer event organisation or catering services. However, it does not allow Professionals to promote ticket sales for such events.
Services outside Spain: Artistealo does not allow Professionals to provide services outside Spain.

7.5.- Opinion spaces and platform content

Artistealo provides opinion areas that are also subject to these Terms of Use and Agreement. As a user of the Service you will be solely responsible for the use you make of them. Artistealo will not edit or control messages posted or distributed by users on the website.

However, Artistealo reserves the right to remove user messages and content. In those discussion areas, you may not publish any content that is: false, unlawful, misleading, injurious, defamatory, obscene, pornographic, indecent, harassing, intimidating, contrary to privacy or publicity rights, abusive or fraudulent.

Artistealo also reserves the right not to publish content or information that is false or contrary to the rights of third parties, as well as to enable an appropriate right of reply channel.

8.- Price and taxes

8.1.- Regarding the Service

The prices of the subscriptions offered on the Service are indicated in euros (€), including the applicable taxes in force at the time of purchase. To contract a subscription, it is essential to pay for it in full and in advance. Payment may be made by credit or debit card.

The Service informs credit and debit cardholders that transactions are carried out through a secure payment gateway, using TLS technology to guarantee the security of data transmission.

Your subscription to the Service will renew automatically for the same period until it is terminated. Unless you cancel your subscription, you authorise us to charge the corresponding subscription fee to your payment method. You may cancel your subscription to the Service at any time, and you will continue to have access to it until the end of your billing period. To the extent permitted by law, payments are non-refundable and we do not provide refunds or credits for any total or partial subscription periods.

8.2.- Regarding clients

As a Professional you understand that you must set the prices for your services inclusive of the applicable VAT. When you are hired by a user, we will receive the amount the user must pay at that time and will transfer it to you after deducting our intermediation commission and the applicable tax thereon.

Our applicable commissions will be communicated to you through the platform at the time you enter and indicate the services you are going to provide. We reserve the right to modify our service commissions at any time. We will notify you before any change takes effect. Changes to commissions will not affect bookings made before they take effect. Service commissions are non-refundable.

9.- Restriction, suspension and termination of the Service

If as a Professional you breach the terms of these legal conditions, stop providing the contracted services without justified cause, or provide services of a different nature or inferior quality to those contracted, Artistealo may restrict, suspend or terminate its intermediation service. In such cases:

a) If your activity is restricted or suspended, you will be notified with reasons to your email address before it takes effect.
b) If it is decided to completely terminate the provision of all your services, you will be provided, at least thirty days before the termination takes effect, with a statement of reasons by email, unless there is a legal obligation or urgent necessity to terminate the service immediately.

In any event, you will be offered the opportunity to clarify the facts and circumstances within the framework of an internal dispute settlement procedure.

10.- Validity of offers

The services offered on the Service, and their prices, will be available for purchase while they appear in the catalogue displayed through the website. In any event, Artistealo reserves the right to make modifications to the Service as it deems appropriate.

By using the service you accept that promotional codes: may only be used for the intended purpose and in a lawful manner; may not be duplicated or sold; may be invalidated by Artistealo at any time; are not valid as cash; may expire before you use them.

11.- Qualification of Professionals

Artistealo will not in any event intervene in the negotiations carried out between a potential client (User) and a professional (Professional), remaining at all times on the sidelines of such negotiations, and will therefore not be responsible in any event for the fulfilment of the obligations of one party to the other.

It is the sole responsibility of the client or potential client (User) to verify the suitability of the services offered by the professional (Professional) and that they meet their needs.

Artistealo will not under any circumstances control or intervene in the performance of tasks and services by the professional (Professional), nor in the adequacy, quality or result thereof. Accordingly, Artistealo excludes, to the fullest extent permitted by law, any liability for damages of any nature that may arise from the performance or result of the work entrusted to the professional.

12.- Classification, differential treatment and access to Professional data

12.1.- Classification

Artistealo uses classification, rating and/or weighting systems to determine the priority of the positioning of one service over another on the website. Specifically, our classification system takes into account: a) the characteristics of the services offered and their price; b) the physical location of the Professional; c) the rating of the service by consumers and users.

12.2.- Differential treatment

Artistealo may adopt specific measures allowing different treatment to be applied to professionals providing the same products or services, based on direct or indirect remuneration or on a different level of access to client data. In such cases, the Professional's classification may be altered, with a visible indication that the position is "sponsored", "recommended" or an equivalent term.

12.3.- Data access

a) Artistealo has access to the Professional's data or to the data generated by their booking volume.
b) The Professional you choose to hire will have access to the data associated with that contract.
c) Professionals may in turn, if they have contracted it, have access to aggregate data of clients or users who use the Service.
d) No data is provided to third parties that is not essential for the proper functioning of the Service.

13.- Exclusion of warranties, liability and indemnity

13.1.- Exclusion of warranties

Except in those cases expressly described in these terms and conditions and to the extent permitted by law, Artistealo is not liable for damages of any nature that may arise from the lack of accuracy, completeness or currency of the information contained in the Service.

Artistealo does not guarantee the availability and continuity of the operation of the Service. Artistealo will endeavour to provide sufficient advance notice of any interruptions that may occur in the operation of the Service, whenever possible.

Artistealo does not own or hold title to any of the services advertised through its platform by Professionals. Consequently, it does not review or validate the services purchased by the buyer. Such problems must be resolved between the user and the contracted Professional.

13.2.- Liability regarding Professionals

If anyone brings a claim against us in connection with the Professional's actions, information or content on Artistealo, the Professional shall indemnify and hold Artistealo harmless from any obligation, damage, loss and expense arising in connection with: a) your access to or use of our Service; b) your breach of our terms or applicable law; or c) any false statement made by you.

In the event of a user complaint or claim that can be verified and that breaches the terms contained herein, the Professional understands that Artistealo may decide to refund the booking price to the client and deduct it from the Professional.

14.- Withdrawal, cancellation and refunds

14.1.- Withdrawal regarding subscriptions

As you are acting as a professional, you do not have a right of withdrawal in respect of the subscriptions or other services you contract.

14.2.- Withdrawal regarding services rendered to end clients

Please note that depending on the type of services that may be advertised through Artistealo, end users do not have a right of withdrawal, in accordance with Article 103 of Royal Legislative Decree 1/2007.

14.3.- Cancellation and refunds

In any event, force majeure events such as major earthquakes, wars or travel restrictions imposed by the authorities due to health events such as pandemics shall be grounds for cancellation of the contract. In such cases, the amounts paid by the client shall be refunded.

If the Service is not rendered or the selected professional does not comply with the terms of the contracted service, the professional must return the amounts received.

15.- Modifications and invalidity

We may update the terms and conditions of the Service in the future. We will inform you of changes by placing a notice in a prominent location on our website and/or by email. Modifications will not take effect before the end of the notice period, which will be at least 15 days. No retroactive modifications will be made except as required by law.

16.- Claims and actions arising from the contract

This Service is governed by Spanish law and in the event of a dispute the parties submit to the courts of Palma de Mallorca and Spanish law.

17.- Deleting your account

The Professional may cancel their account at any time by emailing us or through any of Artistealo's usual contact channels.

Cancellation of their Artistealo account as a Professional will result in the loss of requests received and not yet confirmed by Clients; however, this will in no way release the Professional from the obligation to perform the Services for which they have already been contracted.

You may use the Service to acquire third-party services or to offer, manage and promote your services as a professional, in which case your relationship with us and the user will be governed by the Terms of Use and Agreement for Professionals.

The provision of the Service is carried out as follows:

When you access our platform you will find various services offered by third parties, ordered by category. To contract them, you may register as a user, accept the corresponding terms and conditions, and proceed to pay for the service of your choice, or alternatively contact the relevant professional directly and pay them under the terms you agree.
If you contract the service through the Service, the platform will manage the payment through its payment gateway and will subsequently transfer the amount to the relevant professional.

3.2.- Intermediation

Artistealo facilitates the connection between professionals and users, acting solely as an intermediary between the parties.

In this regard, Artistealo assumes no obligation or liability in respect of the service provided by third parties, which shall be the sole responsibility of the professional chosen by the user. Any complaint regarding the performance, suspension, modification or cancellation of services must be directed to the service provider.

If a User requests a modification or extension of the originally agreed commission to a professional, they must do so through the platform and request a new quote. We cannot under any circumstances be held responsible for agreements made between the User and the Professional outside our platform.

When users contract a service, they enter into a contract directly between themselves and the chosen professional. Artistealo is not a party to and does not intervene in any other way in the contractual relationship between the users. Artistealo acts solely as a collection agent in accordance with the provisions of these Terms of Use and Agreement.

If the User wishes to make a complaint against any professional that may involve a refund of the amounts paid, this must be communicated to that professional. In any event, if you wish, you may notify us of your complaint so that, to the extent we are able, we may seek a solution to your complaint.

3.3.- Provision

In order for us to provide the Service, you must choose the professional you want and contact them, or register as a User, completing the information requested with truthful and accurate data.

Once the Registration process and the creation of the Account are complete, the User may access their Profile at any time to update or modify the data entered.

The User shall be solely responsible for the accuracy and currency of this information. Artistealo reserves the right to verify and validate User Accounts where it has reason to believe that the email addresses provided are not valid and/or legitimately used.

After registration, Artistealo acts solely as an intermediary between the User and the independent Professional. The provision of services is the exclusive responsibility of the Professional with whom you decide to make your booking.

3.4.- Payment protection and dispute resolution

If the option is available and you contract it, Artistealo may offer you a payment protection service in order to attempt to guarantee the provision of the services you have contracted.

Through this mechanism, and upon payment of the additional cost indicated at the time of contracting, Artistealo will retain the price you pay until you confirm through your user account that the service has been correctly provided under the agreed terms.

This service will only withhold the agreed price in the event of objective failures: the Service was not rendered; or its essential characteristics are inconsistent with those contracted.

In the event of a dispute between you and the professional, the Service will use all means at its disposal, including giving both parties a 5-day period to submit their arguments and evidence as they see fit.

The Service's decision on whether the contracted service was actually rendered shall be final, expressly excluding any liability in this regard.

Users and Professionals undertake to use the Service in accordance with applicable law and the terms and conditions of the platform.

4.- External links

The Service may direct you to other websites via links. However, Artistealo has no control over those sites or their content. Therefore, Artistealo is not responsible for the quality, truthfulness or accuracy of the information contained therein.

5.- Age

If you contract on behalf of a company, you acknowledge that you have the appropriate authorisation and representation on behalf of the organisation to do so.

You declare that all the information you provide to access the Service, before and during its use, is truthful, complete and accurate.

6.- Intellectual and industrial property and licence

6.1.- Intellectual and industrial property

Artistealo owns, or holds the relevant authorisations for, all copyrights, trademarks, domains, logos, trade images, trade secrets, patents and other associated intellectual property rights. You may not use our intellectual property rights unless we expressly grant you permission to do so. Furthermore, modification, reproduction, duplication, copying, distribution, sale, resale and other forms of commercial exploitation of the Service are prohibited.

6.2.- Licence

Furthermore, by publishing content on the site, the User or the Professional grants Artistealo a royalty-free, non-exclusive licence with no territorial or time restrictions, until the account deletion is requested, to use, reproduce, distribute, transfer to third parties, sublicense, and display the Content, in connection with the provision of Services by Artistealo, as well as in the context of Artistealo's commercial and/or advertising services and activities.

Users are not permitted to use, copy, adapt, modify, distribute, licence, sell, transfer, publicly display, publicly perform, transmit, broadcast or exploit the Site or the Content published on it, except as expressly permitted in these General Terms and Conditions.

7.- Content

7.1.

As a User you may contribute to the Service by sending us messages to our email address, through the contact form or by sending messages through the platform's messaging system (hereinafter "Content").

Therefore, by sending us Content you grant Artistealo a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence over that Content until the content is withdrawn.

7.2.- Prohibited activities

All users and professionals undertake not to carry out any of the following acts:

a) Access, monitor or copy content or information from this website using robots, crawlers, data scrapers or any other automated means without the explicit written permission of Artistealo;

b) Insert, mirror or otherwise incorporate any part of this website into another without our prior written authorisation;

c) Attempt to modify, translate, adapt, edit, decompile, disassemble or reverse engineer any software program used by Artistealo;

d) Use the website to threaten, harass, defraud, incite or intimidate other persons;

e) Use the website to send or transmit unsolicited mail (spam), chain messages, contests or other bulk messages;

f) Use the website to infringe the rights of third parties, including copyright, trademarks, patents, trade secrets or privacy rights;

g) Attempt to gain unauthorised access to the website through hacking or the transmission of computer viruses;

h) Use any device, software or routine that interferes with the proper operation and security measures of the website;

i) Post fictitious quote requests in order to collect data or for your own commercial purposes.

7.4.- Services not permitted

Artistealo does not under any circumstances permit the provision of the following services: sale of products, lending and consumer credit services, sexual services or services for sexual purposes, long-term rental services, tourist services, sale of event tickets, or services outside Spain.

If as a User you come across any of these services or a Professional offers them to you, we ask that you do not contract them under any circumstances and that you send us an email to info@artistealo.com letting us know what has happened.

7.5.- Opinion spaces and platform content

Artistealo provides opinion areas that are also subject to these Terms of Use and Agreement. As a user of the Service you will be solely responsible for the use you make of them. However, Artistealo reserves the right to remove user messages and content that are: false, unlawful, misleading, injurious, defamatory, obscene, pornographic, indecent, harassing, intimidating, contrary to privacy or publicity rights, abusive or fraudulent.

8.- Price and taxes

8.1.- As a User

You understand that use of the Service may involve charges for the services or goods you contract from a Professional. The price of the contracted services must be paid to Artistealo at the time of contracting.

Payment will be processed as follows:

Selection of the desired service.
Acceptance of the terms of contract.
Payment: Payment for contracted services is made in advance. Artistealo provides you with a payment protection service to ensure the correct provision of the service you have chosen.
Payment methods: The client may pay by credit or debit card, bank transfer or PayPal.

Artistealo will act as a limited collection agent for the third-party Professional. Charges will include applicable taxes where required by law, will be final and non-refundable unless otherwise provided in these conditions or in the Professional's conditions.

Artistealo informs credit and debit cardholders that transactions are carried out on a secure page, using TSL technology to guarantee the security of data transmission.

9.- Validity of offers

10.- Qualification of Professionals

It is the sole responsibility of the client or potential client (User) to verify the suitability of the services offered by the professional (Professional) and that they meet their needs.

Artistealo will not under any circumstances control or intervene in the performance of tasks and services by the professional (Professional), nor in the adequacy, quality or result thereof.

11.- Classification, differential treatment and access to Professional data

11.1.- Classification

Artistealo uses classification, rating and/or weighting systems to determine the priority of the positioning of one service over another on the website, taking into account: a) the characteristics of the services offered and their price; b) the physical location of the Professional; c) the rating of the service by consumers and users.

11.2.- Differential treatment

Artistealo may adopt specific measures allowing different treatment to be applied to professionals, based on direct or indirect remuneration. In such cases, a visible indication will be made that the position or classification is "sponsored", "recommended" or an equivalent term.

11.3.- Data access

a) Artistealo has access to the Professional's data or to the data generated by their booking volume.
b) The Professional you choose to hire will have access to the data associated with that contract.
c) Professionals may in turn, if they have contracted it, have access to aggregate data of clients or users who use the Service.
d) No data is provided to third parties that is not essential for the proper functioning of the Service.

13.- Exclusion of warranties, liability and indemnity

13.1.- Exclusion of warranties

Artistealo does not guarantee the availability and continuity of the operation of the Service and does not own any of the items or services for sale or sold through its platform by Professionals.

14.- Withdrawal, cancellation and refunds

14.1.- Withdrawal

For the purposes of Article 103 of Royal Legislative Decree 1/2007 of 16 November, there shall be no right of withdrawal when: a) the service has been fully performed; b) the consumer and user has specifically requested that the trader visit them to carry out urgent repair or maintenance operations; c) the service consists in the transport of goods, food or services related to leisure activities, if the contracts provide for a specific date or period of performance.

14.2.- Cancellation and refunds

Outside the above cases, if the client decides to voluntarily cancel the service before it is rendered, they must request this through info@artistealo.com with as much notice as possible. If you cancel the requested service before it is rendered, the amount previously paid will be refunded to you.

This Service is governed by Spanish law.

If the Service is contracted by a company, in the event of a dispute the parties submit to the courts of Palma de Mallorca and Spanish law.

17.- Deleting your account

The User and the Professional may cancel their Account at any time through their profile on Artistealo.

If a user or Professional deregisters, we will retain their information for a period of 90 days so that they can easily reactivate their account. Once that period has elapsed, all information will be deleted except that which we are required to retain in order to comply with our legal obligations.
